Terms of use
These terms apply to your use of Billing for Mosdos (the "Service"), provided by [Company name], [Company address] (company number [Company number]) ("we", "us"). By using the Service you agree to them on behalf of yourself and the organisation you use it for (the "Organisation").
1. The Service
The Service helps Organisations record their clients (students and parents, members, donors), charges, payments and pledges, produce statements, and contact their own members. Features may change over time. We will give reasonable notice of any change that materially reduces what the Service does.
2. Accounts
- Each Organisation has its own account. The Organisation decides who has access and is responsible for its users' actions.
- Keep sign-in details private. Tell us straight away at admin@billingformosdos.com if you think an account has been misused.
- You must be at least 18 and authorised to act for the Organisation.
3. Your data
- The Organisation owns the data it puts into the Service ("Customer Data").
- The Organisation is the data controller for Customer Data. We act as its data processor and handle Customer Data only to provide the Service and on the Organisation's instructions, as set out in our privacy policy.
- The Organisation is responsible for having a lawful basis to hold its members' data and to contact them, including consent for marketing texts or emails where it is needed.
- We never sell Customer Data.
4. Texts and email
- Texts (SMS) and emails are only sent when the Organisation sets up a sending provider and presses Send, or switches on a schedule.
- The Organisation must honour opt-outs (for example, a reply of STOP) and use the opt-out flag in the Service.
- Message charges from the sending provider are the Organisation's responsibility.
5. Acceptable use
You must not:
- use the Service for anything unlawful, fraudulent or harassing;
- upload data you have no right to use;
- try to get into accounts or data that are not yours, test or break our security, or overload the Service;
- resell the Service without our written agreement.
We may suspend access that puts the Service or other customers at risk. Where we reasonably can, we will tell you first.
6. Availability and support
We aim to keep the Service available and backed up, but we do not promise it will be uninterrupted or error-free. Please check important figures before relying on them, for example before sending statements.
7. Fees
Any fees, and how they are billed, will be agreed with the Organisation separately. The public demo is free.
8. Ending
- The Organisation can stop using the Service at any time and ask us for an export of its data.
- After an account is closed we delete Customer Data within the period set out in the privacy policy, unless the law requires us to keep it.
9. Liability
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
- Otherwise, we are not liable for indirect or consequential loss, or for loss of profit, revenue, data or goodwill.
- Our total liability in any 12 months is limited to the fees paid to us for the Service in that period, or £100 if no fees were paid.
10. Changes to these terms
We may update these terms. If a change is significant, we will tell account owners before it takes effect.
11. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
